Terms & Conditions
Read carefully before working with Gina Diamond (GD) or engaging with her proprietary email system including any audio, written, and/or visual presentations and programs. By signing up for support or accessing/using the presentations and program(s), you acknowledge that:
- you have read this agreement,
- you understand it, and
- that you accept and agree to be bound by its terms.
This agreement is a legal contract between Gina Diamond, and name: __________________________ ,(“you”, an individual) at address:__________________________________. Whereas, you desire to engage GD for wellness coaching services to you in the form of webinars, audio, written, phone consultations and/or visual presentations;
NOW, THEREFORE, the Parties agree as follows:
By accepting the terms of this document you are agreeing to enter a private gift agreement whereby you are creating a private partnership with Gina Diamond. All monies given to GD are based on an agreed upon gift amount in exchange for her natural strengths and best practices to help you heal, grow, and transform.
GD has produced above-average results, but she does not promise a quick-fix, a cure-all, or a substitute for sound medical advice. She is not a psychotherapist, counselor, a certified dietician or a medical doctor and does not claim to be one. She is an educator, health coach, brain management consultant, and soon to be Neo-Shamanic Healing Mastery Practitioner. As such, GD, Does Not Provide Medical Advice or Therapy. As with any changes affecting your health, GD recommends that you consult with a trusted medical doctor before embarking on this journey or before going off any medications. Nothing claimed by GD or any entities associated with her, including her website and social media/blog, is intended to be medical advice, nor is it anyway a substitute for professional medical advice, diagnosis, and treatment.
Agreement Acceptance
You are automatically accepting my Terms and Conditions if you:
1. gift money in exchange for a product from my site or service created by GD
2. enter your contact information at www.consciousnutritionstrategies.com
Further, you acknowledge that you understand and agree to all of the terms below, including those related to program donations, refunds, and confidentiality. Go here for more information about GD’s coaching policies.
Weight Loss and other Health Results Will Vary.
Every person’s body and experience is unique. The rate of reaching your goals will be different for each person. Transformations can and do happen all the time on GD’s protocol and the type and extent depend largely on the amount of effort that you put in and the challenges you are experiencing when you enter the program and how quickly your body responds.
Gift Refund Policy: Refund considerations are specific to what you signed up for and will not be considered unless you have completed all the assignments, shown up for all the calls, and given 100% of your effort to the program. All requests must be in writing and a response will be given in 7 days or less unless the office is shut for vacation, in which it can take longer.
You further acknowledge that in accepting the terms of this Agreement, you are taking full responsibility for YOUR OWN success. Thus, you agree that instead of requesting a refund of the monetary gift given, you will ask for help FIRST if you are having any challenges.
Limited Liability: In no event will Gina Diamond (GD) or an entities associated with her be liable to you or any party related to you for any damages, including damages for psychological or physical distress, damages for loss of business profits or other pecuniary loss, whether under a theory of contract, warranty, tort (including negligence) products liability or otherwise, even if GD or anyone associated with her work has been advised of the possibility of such damages. Limitations herein shall be applied to the greatest extent enforceable under applicable law.
Confidentiality: Only authorized users, who have duly obtained access to any programs, literature, audio, videos, documentation or log in credentials offered by GD by personally agreeing to the terms of this Agreement are permitted use and participation with such Programs.
Intellectual Property: You acknowledge that any Audio and/or Visual Presentations, Documentation, and other elements of the email system are the sole Intellectual Property of GD under United States copyright, trademark and other intellectual property laws and international treaties. You further acknowledge and agree that, as between you and GD and its third party licensors own and shall continue to own all right, title, and interest in and to the Audio and/or Visual Presentations, Documentation, and other elements of the email system, including associated intellectual property rights under copyright, trade secret, patent, or trademark laws.
Indemnification: You will, at your own expense, defend, indemnify, and hold Gina Diamond, her agents, and employees harmless from any and all claims, actions, liabilities, injuries, damages, losses, grants, costs, and expenses, including attorney fees, arising out of or in connection with any use of the Program(s) of this Agreement.
Paper Version Amendment: GD and any entities associated with her reserve the right, in her sole discretion, to amend this Agreement by posting an updated version of the Agreement at www.consciousnutritionstrategies.com.
Governing law: This Agreement shall be governed by and interpreted in all respects in accordance with the laws of the United States of America and the State of Washington. The venue for any dispute shall be Island County, Washington.
Termination: Gina Diamond (GD) may terminate this Agreement at any time in its discretion upon notice to YOU without transferring back any money gifted.
